Photography Policy

The National Mining Hall of Fame and Museum (NMHFM) allows non-commercial photography of its exhibits, facilities and building, and the access to and use of images in its Collections for educational, research, and Museum marketing purposes by students, professors, scholars, the media, the general public, and Museum staff consistent with the long term preservation of the objects in its collections.

Guidelines and Procedures for General Photography

General photography using hand-held camera, no tripods or extra flash equipment (non-commercial photography) is allowed, provided that it:
* Does not damage the objects in the Collection, exhibit furniture, or facilities
* Does not interfere with the safety and enjoyment of visitors
* Complies with relevant state and federal copyright and rights of privacy laws and regulations

Copyright Recognition, and Credit Line

The Museum does not own copyright of images taken by a non-staff or uncontracted photographer and as such has no control over such images. However, whenever images of the Museum or its collections are published the Museum requests that the photographer identify the Museum as: "National Mining Hall of Fame and Museum."

The Museum does not own copyrights to images or works of art in our collections that are not in the public domain. The museum requests that images of these works of art be used for personal use only and that credit be given to the artist.

Special Permission Required for Commercial Photography or Film

For individuals requesting to photograph using equipment other than a hand-held camera, or to film in the galleries or public spaces, please contact director@mininghalloffame.org, at least one week prior.

Privacy Policy

Protecting your privacy is important to us and we want you to understand what information we collect, how we use it, and what steps we take to safeguard your privacy. The National Mining Hall of Fame & Museum does not collect personal information about individuals, such as names and mailing or e-mail addresses, unless the individual visiting the National Mining Hall of Fame & Museum (NMHFM) or Online Store (collectively referred to as the "NMHFM Website") knowingly provides it. By using the NMHFM Website, you agree to be bound by the terms and conditions of the NMHFM Privacy Policy, as outlined below.

Online Purchases

When you register for a program, purchase a product or membership, or make a donation using the NMHFM Website, we need to know your name, billing and shipping addresses, telephone number, e-mail address, and credit card information to process your order. Your credit card information will be used only as needed to process your transaction. Sale information is confidential; once the sale is completed the only records retained are those required for audit.

Research Services

If you request research services online, or by phone or letter, we will keep your information on file temporarily. We use personal identifying information that you have provided online--such as name,telephone number, email address, and physical address--only to fulfill your research request.

Volunteer Information

If you volunteer for NMHFM, we may ask for personal information (name, address, phone number, email, gender, date of birth, education, references, emergency contact names and information, and social security number), permission to run a background check, and to sign a liability release, confidentiality agreement, and photo release.

Online Contests

NMHFM may occasionally offer visitors the opportunity to participate in online contests or sweepstakes. If you choose to enter, you will need to provide your name and e-mail address so that we may contact you in connection with the contest. We may also request that you provide us with certain other information, such as your zip code, state of residence, and grade in school (provided that you are at least thirteen years of age).

Children 12 and under

NMHFM does not solicit personal information from children. Visitors twelve years of age and under should remember that they are required to obtain an adult's permission before submitting any personal information to this or any other website.

NMHFM E-Newsletter

As a service, NMHFM offers members a subscription to our online newsletters as a complimentary benefit of membership. You may designate whether to receive this by email or postal mail.

Cookies

Cookies are small files of information that are stored on your computer's hard drive by your Web browser. The cookies we use do not contain any personal information. Most Web browsers automatically accept cookies, but you can change the preferences of your browser so that it does not accept them. In order to use all the features of the NMHFM website, we recommend that you accept cookies.

Use and disclosure of the information it collects on the NMHFM Website

NMHFM uses the personal information you provide to us for internal purposes, such as filling and tracking your purchase(s), analyzing trends, and collecting statistics. NMHFM may also compile and provide aggregate statistics about our visitors, customers, sales,traffic patterns and related site information to third parties, but these statistics will not include any personally identifying information.

We do not sell our purchaser, visitor, member or donor information.

If you have provided us with your e-mail or postal mailing address, we may send you communications in order to inform you of events or activities at or related to the NMHFM that we believe may be of interest to you, or to alert you about sales or other NMHFM promotional events. If you do not want us to use your e-mail address to contact you for these purposes, you may send an e-mail message containing your name and postal address to info@mininghalloffame.org, or simply opt out of the e-mail communication that you receive.

Linking

The NMHFM Website may include links to websites operated by third parties over which we have no control. Once you leave the NMHFM Website, our Privacy Policy will not apply, and you access such sites at your own risk.

Security

The NMHFM secure server software uses industry-standard Secure Socket Layer (SSL) encryption technology. SSL encodes your personal information, including credit card number, name, and address, as it travels over the Internet so that all transactions are secure. If you prefer, you may also purchase NMHFM memberships, register for programs, or make donations by phone at 719-486-1229.

Revisions to our Privacy Policy

Please note that the NMHFM may revise its privacy policy at any time, without notice, such changes to be effective immediately upon posting on the NMHFM Website. Such revisions may arise in response to changes in the law, policy, or other factors. We encourage you to periodically visit this page to review our most current policy.

E-commerce Store Policies

You may purchase merchandise or NMHFM memberships from the online store located at www.mininghalloffame.org (“Store”).  You agree to any additional rules, procedures, or terms applicable to such items.   

While we endeavor to keep our website inventory up to date at all times, there may be circumstances when an item shows as available and instock, but in reality is not. Should that happen, we will make every effort to contact you by telephone or email to receive instructions from you on whether to cancel or hold the order for future filling. The NMHFM shall not be held liable to fulfill orders when it does not have inventory to do so and is not under any obligation to restock the item(s) to fulfill an order.

Refund Policy

All proceeds from the sale of merchandise are reinvested in the National Mining Hall of Fame & Museum. Your purchases help to support our museum, its exhibits, overhead costs and programs.

Within 30 days from the date of purchase, we will make exchanges on merchandise that you are not satisfied with, provided it is not used or worn. We cannot accept returns after 30 days from the date of purchase. To complete your exchange, we require a receipt or proof of purchase. Gift Certificates are only to be used for purchase of merchandise, admissions or services; they cannot be exchanged for cash.

There are certain situations where only partial refunds are granted (if applicable):

*Books sold new that are returned with obvious signs of use
*CD, DVD, VHS tape, or other digital media that has been opened
*Any item not in its original condition, is damaged or missing parts for reasons not due to our error
*Any item that is returned more than 30 days after purchase
*Shipping costs will not be credited

Your item must be unused and in the same condition that you received it. It must also be in the original packaging. Once your item(s) is received and inspected, we will send you an email to notify you that we have received your returned item. We will also notify you of the approval or rejection of your request. If you are approved, then your exchange will be processed, and the replacement item(s) will be shipped.

Sale items (if applicable)
All transactions of items on sale and clearance are final.

Damaged or Defective Items
Every effort is made to package your items with care. If you believe your purchase was damaged in shipping or defective, please contact us. We may ask you for photographs or to send the items back to us for examination. We will replace items if they are defective or damaged. Depending on the item, you may be responsible for a portion or all of the shipping costs.

To return your product, send us an email at info@mininghalloffame.org or give us a call at 719-486-1229 to make arrangements.

You are responsible for paying shipping costs for the return of your item. Shipping costs are non-refundable.

PERSONAL INFORMATION WE COLLECT in our Ecommerce Store 

This Privacy Policy describes how your personal information is collected, used, and shared when you visit or make a purchase from the National Mining Hall of Fame & Museum’s online gift shop.

We do not collect personal information from you other than for purposes of processing your payment electronically and by setting up an account with your name and contact information. The information collected is also used for shipping of your purchases.

The National Mining Hall of Fame & Museum will not send you communications other than occasional information on sales or special events we think you might be interested in. We do not share or sell this personal information with any other party or organization. 

SHARING YOUR PERSONAL INFORMATION
